Terms of Service

1. Acceptance of Terms

By accessing or using the Arc Cert platform ("Service"), operated by F7 Software Inc ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Arc Cert provides a cloud-based welding equipment certification and management platform designed to assist businesses in performing, tracking, and managing equipment certifications in accordance with IEC 60974-14 and related standards. The Service includes web and mobile applications, data storage, certificate generation, job management, and related tools. The Service is provided "as-is" and is intended as a professional tool to assist qualified personnel; it does not replace the professional judgment of certified technicians.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access to your account
  • Immediately notify us if you discover or suspect any security breach related to the Service
  • Be responsible for all activity that occurs under your account

4. Subscription Plans and Payment

Access to the Service is provided through subscription plans as described on our Pricing page. By subscribing, you agree to the following:

  • Billing: Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. You authorize us to charge your payment method on file for all applicable fees.
  • Free Trials: We may offer free trial periods. At the end of a trial, your account will be converted to a paid subscription unless you cancel before the trial ends.
  • Price Changes: We reserve the right to change subscription prices with 30 days' prior notice. Price changes take effect at the start of your next billing cycle.
  • Refunds: Subscription fees are non-refundable except where required by applicable law. Partial-month or partial-year refunds are not provided for cancelled subscriptions.
  • Overdue Payments: Accounts with overdue payments may have access restricted or suspended until payment is received.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload or transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to generate fraudulent or falsified certification documents
  • Resell, sublicense, or redistribute access to the Service without written consent

6. Intellectual Property

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of F7 Software Inc and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. You retain ownership of all data and content you upload to the Service.

7. User Data and Content

You retain all rights to your data and content uploaded to the Service. By using the Service, you grant us a limited license to:

  • Store, process, and display your data as necessary to provide the Service
  • Create backups of your data for disaster recovery purposes
  • Use anonymized, aggregated data to improve the Service (no personally identifiable information will be shared)

8. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

9. Service Availability and Modifications

We strive to maintain the Service available 24/7, but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We may perform scheduled maintenance that temporarily limits access. We will endeavour to provide reasonable advance notice of any planned downtime. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. F7 SOFTWARE INC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. CERTIFICATION RESULTS AND REPORTS GENERATED BY THE SERVICE ARE TOOLS TO ASSIST QUALIFIED PERSONNEL AND DO NOT REPLACE PROFESSIONAL JUDGMENT OR INDEPENDENT VERIFICATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL F7 SOFTWARE INC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless F7 Software Inc and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to any use of the Service's content other than as expressly authorized in these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may request an export of your data within 30 days of termination. After 30 days, we reserve the right to delete your data in accordance with our data retention policy.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which F7 Software Inc operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Certification Company Directory

Arc Cert provides a "Find a Certifier" directory feature that lists third-party certification companies who use our software platform. This directory is provided solely as a convenience and informational resource.

  • The directory is a listing of independent third-party businesses. Arc Cert does not own, operate, employ, endorse, or control any company listed in the directory.
  • Inclusion in the directory does not constitute a recommendation, endorsement, guarantee, or warranty of any listed company's services, qualifications, competence, or workmanship.
  • Arc Cert is not a party to any transaction, agreement, or engagement between you and any listed certification company. Any dealings you have with a listed company are solely between you and that company.
  • Arc Cert makes no representations or warranties regarding the accuracy, completeness, or timeliness of any information displayed in the directory, including but not limited to company names, addresses, contact information, services offered, or geographic locations.
  • Arc Cert shall not be liable for any loss, damage, injury, claim, or liability of any kind arising from or related to your use of the directory, your interactions with any listed company, or any services performed by any listed company.
  • You are solely responsible for evaluating and selecting a certification company. We strongly recommend verifying credentials, insurance, accreditation, and references independently before engaging any service provider.

By using the directory, you acknowledge and agree that Arc Cert's sole role is providing a software platform, and the directory serves only to connect users with companies that utilize our platform.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
